Independent institutions must submit a proposal, necessary fee, and petition to the Board of Higher Education. The Articles of Amendment/Organization or Foreign Corporation Certificate must also be filed be with the Secretary of the Commonwealth. Authorization not applied for

 Minnesota  Yes Institutions must be authorized by state regardless of meeting a physical presence standard. Most private colleges and out-of-state public postsecondary educational institutions offering programs in Minnesota must be registered with the Office of Higher Education. A registered institution must have approval to use "academy", "college", "institute" or "university" in its name and to grant degrees for programs offered in Minnesota or to Minnesota residents where the students do not leave the State of Minnesota for a majority of the program or course. Out-of-state public institutions wishing to offer distance education in Missouri should submit a letter to the MDHE affirming their compliance with both regional accrediting standards and the MDHE Principles of Good Practice for Distance Learning and Web-Based Courses.  New Mexico  No  No Authorization required NMHED is currently reviewing their state approval process to ensure it reflects appropriate oversight and desired outcomes. Therefore, public out-of-state institutions are given a one year waiver from meeting this New Mexico statutory requirement until June 30, 2013. Authorization not required
